The Supreme Court sided with a rural Colorado church Tuesday that challenged the state Democrat governor’s COVID rules restricting building capacity in some parts of the state.

The 6-3 decision overturned lower court rulings that had upheld Gov. Jared Polis’s church gathering limits to a maximum of 25 percent or 50 people, whichever is fewer, and ordered lower courts to re-examine the case.

“Today in Colorado it is perfectly legal for hundreds of shoppers to pack themselves cheek by jowl into a Lowes or other big box store or patronize any one of the thousands of other retail establishments that are not subject to draconian numerical limits,” church attorney Barry Arrington told National Review.

In the brief unsigned order, Justices Elena Kagan, Stephen Breyer, and Sonia Sotomayor dissented, arguing the case was moot given the state had already repealed its COVID orders on churches following a November ruling in a similar case out of New York nullifying religious restrictions.

The case was brought by the High Plains Harvest Church north of Denver, arguing the state was unlawfully targeting religious institutions by imposing harsher restrictions on churches than shopping centers.

on a New Jersey case brought by a Catholic priest and a rabbi. This ruling overturned limits on religious gatherings in houses of worship, wiping out executive rule-favoring opinions in the lower courts.

The cases upholding religious liberty come on the heels of rare public remarks by Justice Samuel Alito criticizing coronavirus lockdowns this year as placing “previously unimaginable” restrictions on American freedom.

“We have never before seen restrictions as severe, extensive and prolonged as those experienced for most of 2020,” Alito said in a virtual speech to The Federalist Society. “The COVID crisis has served as sort of a constitutional stress test.”

Son of prominent conservative leader Bozell arrested in connection with Capitol siege

Leo Brent Bozell IV, the son of conservative leader L. Brent Bozell III, is facing federal charges in connection with the Jan. 6 breech of the U.S. Capitol.

Bozell is charged with obstructing an official proceeding, entering a restricted building and disorderly conduct, according to a federal complaint unsealed Tuesday.

The official affidavit includes photos and videos that appear to show Bozell inside of the U.S. Capitol Building, including the Senate chambers.

At least one photo shows Bozell wearing a sweatshirt emblazoned with a logo for a Christian school at which he once coached girls basketball, according to the Huffington Post.

The FBI obtained a photo of him posing with a student of a school, in Hershey, Pa.

His father founder, who founded the Media Research Center and other conservative groups, has condemned the riots, saying, “You can never countenance police being attacked. You cannot countenance our national capitol being breached like this. … I think it is absolutely wrong,” according to NewsBusters.

Trump calls Limbaugh ‘legend,’ in first TV interview since Senate trial

Former President Trump on Wednesday afternoon praised the career of conservative talk radio host Rush Limbaugh, who has died of cancer.

“He loved his country, and he loved his fans,” Trump said on the Fox News Channel. “He is a legend.”

The interview was Trump’s first since the conclusion of his Senate impeachment trial last week.

Limbaugh’s wife, Kathryn, announced her husband’s death earlier in the day on his radio show. He had been diagnosed about a year ago with Stage-IV lung cancer. He was 70.

The president also said he had a personal friendship with Limbaugh, who was an early supporter of his 2016 presidential bid and who, like Trump, thought the president won reelection in 2020.

Trump also pointed out that Limbaugh was a provocateur in his views about conservative politics that often sparked backlash from liberals and other critics. 

Trump last year in his State of the Union address awarded Limbaugh the Presidential Medal of Freedom.

Rep. Bennie Thompson targets Trump, Giuliani, Proud Boys and Oath Keepers in Capitol riot lawsuit

Rep. Bennie Thompson is targeting former President Donald Trump, Rudy Giuliani, the Proud Boys and the Oath Keepers in a suit alleging that they conspired to incite the violence that transpired at the U.S. Capitol on Jan. 6.

The lawsuit filed on behalf of the long-serving Mississippi Democrat by the NAACP and the Cohen Milstein Sellers & Toll law firm claims that the defendants broke the 1871 Ku Klux Klan Act by attempting to meddle in Congress’s certification of the Electoral College count, according to NPR.

“The insurrection at the Capitol was a direct, intended, and foreseeable result of the Defendants’ unlawful conspiracy,” the lawsuit claims. “It was instigated according to a common plan that the Defendants pursued since the election held in November 2020.”

According to the outlet, Thompson told reporters on Tuesday: “I am privileged to partner with the NAACP to have my day in court so that the perpetrators of putting members of Congress at risk can be held accountable.”

Trump was acquitted on Saturday in his Senate impeachment trial in a 57-43 vote. While a majority of senators voted that the former commander-in-chief was guilty regarding the single article of impeachment that was passed by the House last month during Trump’s waning days in office, the 57 guilty votes failed to clear the two-thirds supermajority required to secure a conviction.
